TERMS OF SERVICE
These Terms of Service govern your use of the CASED BY SK website and your purchase of products through our website.
By accessing our website or placing an order, you agree to be bound by these Terms of Service. Please read them carefully before using our website or completing a purchase.
1. DEFINITIONS
In these Terms of Service, “CASED BY SK”, “CSK”, “we”, “us” and “our” refers to the brand CASED BY SK, based in Accra, Ghana.
“You”, “your” or “customer” refers to any person who accesses our website, places an order, or purchases a product from us.
“Website” refers to the CASED BY SK website and any pages, features, content or services made available through it.
“Products” refers to the phone cases, custom creations and other products made available for purchase through our website.
2. OUR PRODUCTS
CASED BY SK curates and sources products that align with our standard for design, quality and everyday use.
Our current collections are sourced and curated with each product selected for its design, quality and everyday functionality.
Product descriptions, specifications and availability are provided as accurately as reasonably possible. Minor differences in colour, texture or appearance may occur due to lighting, photography, screen settings and the characteristics of individual products.
Protection, materials and other product features may vary between collections and individual products. Please refer to the relevant product page for the available product information before placing your order.
3. ORDERS
You may place an order through our website by selecting your desired product, phone model and quantity and completing the checkout process.
Placing an order does not automatically guarantee acceptance of that order. We reserve the right to accept or decline an order where reasonably necessary.
We may cancel or refuse an order where, for example, a product is unavailable, there is an obvious pricing or product information error, the information provided by the customer is invalid or incomplete, or we reasonably suspect fraudulent or unauthorized activity.
If we cancel an order after payment has been made, any applicable refund will be processed in accordance with our refund procedures.
4. PRICING
Product prices displayed on our website are stated in Ghana Cedis unless otherwise indicated.
We may display prices in other currencies for convenience. Displayed currency conversions may be indicative and do not necessarily represent the currency in which your payment will be processed.
Prices may change at any time before an order is placed. Once an order has been successfully accepted, the applicable product price for that order will not be changed simply because the website price changes afterwards.
Delivery fees are separate from the product price and are paid directly to the third-party delivery rider, as described in our Shipping & Returns policy.
5. PAYMENT
Payment is required to validate an order before delivery.
Payments may be processed through our selected payment provider. Available payment methods will be displayed during checkout.
We do not ask customers to provide or send their full card details directly to CASED BY SK.
Payment processing may be subject to the terms and policies of the relevant payment provider.
6. DELIVERY
We currently deliver within Accra and selected areas across Ghana.
Our normal delivery timeframe is 2–3 business days. In-stock orders may be dispatched sooner, while products requiring additional sourcing may require additional processing time.
We will make every reasonable effort to contact you before dispatch to confirm your order and delivery details.
You are responsible for ensuring that the information provided at checkout, including your name, phone number, WhatsApp number and delivery address, is accurate.
Where an unexpected delivery delay occurs, we will contact you where reasonably possible and provide an updated delivery estimate.
If delivery cannot be completed because you are unavailable or because of circumstances relating to the information or instructions provided by you, additional delivery attempts or associated costs may be your responsibility.
7. CANCELLATIONS
You may request cancellation of an order within 12 hours of placing it, provided the order has not already been dispatched.
If an order has been dispatched, cancellation will no longer be possible.
Approved cancellations will be refunded. The time required for a refund to appear in your account may depend on your payment method or payment provider.
8. RETURNS & EXCHANGES
We do not accept returns based solely on a change of mind.
Returns or exchanges may be considered where you receive the wrong item, a damaged item, or a product with a genuine defect.
Any issue must be reported within 48 hours of receiving your order.
To help us assess an issue, you may be required to provide your order number, photographs of the product, photographs or video of the packaging, and a video showing the issue where applicable.
We will review the information provided and cross-check it against our order and delivery records before determining the appropriate resolution.
Where an issue is confirmed to be our responsibility, we may arrange collection and provide an appropriate remedy, which may include a replacement, exchange or refund.
9. INCORRECT PHONE MODEL
Customers are responsible for selecting the correct phone model before completing an order.
If you notice that you selected the wrong model before dispatch, contact us as soon as possible so we can try to correct the order.
If the order has already been dispatched, a cash refund will not automatically be provided simply because an incorrect phone model was selected.
Where appropriate, we may arrange an exchange for the correct model. Any additional delivery or exchange costs resulting from an incorrect customer selection may apply.
10. CUSTOM CREATIONS
Custom creations are made specifically for the customer and are therefore non-refundable and non-returnable where the issue is not caused by CASED BY SK.
Where a confirmed issue with a custom creation is caused by CASED BY SK, we will review the matter and determine the appropriate resolution.
11. INTELLECTUAL PROPERTY
The CASED BY SK name, logo, wordmark, website design, original graphics, photography, written content and other original brand-created materials are protected by applicable intellectual property laws and remain the property of CASED BY SK or their respective rights holders.
Some products and product imagery featured on our website may be sourced from third parties. Any intellectual property rights in third-party designs, products or imagery remain with their respective owners or licensors.
Nothing in these Terms transfers ownership of third-party intellectual property to CASED BY SK or to you.
You may not reproduce, modify, distribute, sell or commercially exploit our original brand assets or website content without appropriate permission.
12. USE OF THE WEBSITE
You agree to use our website only for lawful purposes and in a way that does not interfere with the operation, security or availability of the website.
You must not attempt to gain unauthorized access to our website, systems, accounts or services, or use the website to engage in fraudulent, abusive or unlawful activity.
13. LIABILITY
We make reasonable efforts to ensure that the information on our website is accurate and up to date. However, we do not guarantee that the website or all information available through it will always be complete, accurate or uninterrupted.
To the extent permitted by applicable law, CASED BY SK will not be responsible for losses arising from circumstances outside our reasonable control, including third-party delivery delays, payment-provider issues, technical interruptions or events beyond our control.
14. CHANGES TO THESE TERMS
We may update these Terms of Service from time to time to reflect changes to our business, products, services or legal requirements.
The updated version will be published on this website with its revised date. Your continued use of the website after an update means that the revised Terms will apply to future use of the website and future orders.
15. GOVERNING LAW
These Terms of Service are governed by the laws of Ghana.
Any disputes arising in connection with these Terms or your use of our website will be subject to the applicable laws and jurisdiction of Ghana.
